As we continually work to improve our Services, we may need to change this Privacy Policy from time to time. This Privacy Policy covers how we treat Personal Data that we gather when you visit our website or access or use our Services, including Vibe OnCall. "Personal Data" means any information that identifies or relates to a particular individual and also includes information referred to as "personally identifiable information" or "personal information" or "sensitive personal information" under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we don't own or control or people we don't manage.

Categories of Personal Data We Collect

The categories and uses described below include Personal Data that Vibranium Labs collects as a data controller (such as account and billing information), as well as Customer Data that we process solely as a service provider / processor on behalf of enterprise customers and only in accordance with their instructions.

Providing, Customizing and Improving the Services

• Creating and managing your account or other user profiles.
• Processing orders or other transactions; billing.
• Providing you with the products, services or information you request.
• Meeting or fulfilling the reason you provided the information to us.
• Providing support and assistance for the Services.
• Improving the Services, including testing, research, internal analytics and product development.
• Personalizing the Services, website content and communications based on your preferences.
• Doing fraud protection, security and debugging.
• Automated processing is used to assist with incident analysis, prioritization, and coordination, and does not produce legal or similarly significant effects on individuals without appropriate human oversight where required by law.

• Sending promotional communications and marketing content related to the Services.

International Transfers. Personal Data may be processed and stored in the United States and other jurisdictions. Where required by applicable law, including the Personal Information Protection Act of Korea (PIPA), Vibranium relies on user consent, contractual necessity, or other lawful transfer mechanisms. Users may refuse overseas transfer of Personal Data; however, doing so may limit or prevent access to certain features of the Services.

We may use such aggregated, de-identified or anonymized data and disclose it with third parties for our lawful business purposes, including to analyze, build and improve the Services.

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, "Cookies") to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base, identify visitors to our website, and operate and improve our Services. Cookies are small pieces of data, usually text files, placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s).

For example, we use PostHog to collect and analyze information about how you interact with our website and the Services, including feature usage and product interactions within the Services, in order to improve the Services and understand how they are used. This may include optional session replay, which records clicks, scrolling, and navigation on our website if you enable the Session Replay preference in our cookie settings. Retargeting/Advertising Cookies. Retargeting/Advertising Cookies collect data about your online activity and identify your interests so that we can provide advertising that we believe is relevant to you. We currently use the Meta Pixel (Meta Platforms, Inc.) and Google advertising tags (Google LLC) on our website for advertising, retargeting and campaign measurement. Information collected by these technologies is subject to Meta's Privacy Policy (https://www.facebook.com/privacy/policy) and Google's Privacy Policy (https://policies.google.com/privacy). Website Visitor Identification. We use a website visitor identification service to help us identify individuals and organizations that visit our website. When you visit our website from within the United States, this service may use Cookies, device identifiers, IP addresses, and its identity network to associate your visit with a professional profile, which may include your name, job title, employer, business email address, and LinkedIn profile URL, along with the pages you viewed on our website. We use this information for lead generation, sales outreach, and to understand interest in the Services. You may opt out of this identification network at any time at https://app.retention.com/optout.

We may also disclose hashed identifiers (such as hashed email addresses) derived from our marketing lists to advertising platforms, including Google (Customer Match) and Meta (Custom Audiences), so those platforms can show our advertisements to those individuals or to audiences with similar characteristics.

You can decide whether or not to accept Cookies through your internet browser's settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. We may serve advertisements, and also allow third-party ad networks, including third-party ad servers, ad agencies, ad technology vendors and research firms, to serve advertisements through the Services. These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors ("Interest-Based Ads"). Information for Interest-Based Ads (including Personal Data) may be provided to us by you, or derived from the usage patterns of particular users on the Services and/or services of third parties. Such information may be gathered through tracking users' activities across time and unaffiliated properties, including when you leave the Services. When establishing a retention period for specific categories of data, we consider who we collected the data from, our need for the Personal Data, why we collected the Personal Data, and the sensitivity of the Personal Data. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally. Enterprise customers may configure retention periods for Customer Data, subject to applicable law.

• We retain your profile information and credentials for as long as you have an account with us.
• We retain your payment data for as long as we need to process your purchase or subscription.
• We retain your device/IP data for as long as we need it to ensure that our systems are working appropriately, effectively and efficiently.

As noted in the Terms of Use, we do not knowingly collect or solicit Personal Data from children under 13 years of age; if you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information as quickly as possible. If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know, access, correct, or delete your Personal Data, and the right to opt out of the sale or sharing of your Personal Data, subject to applicable law. We "sell" or "share" (as those terms are defined under applicable law) identifiers, professional or employment-related information, internet or other electronic network activity information, and inferences with the Advertising Partners described above for purposes of cross-context behavioral advertising. We do not knowingly sell or share the Personal Data of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes of inferring characteristics about consumers. Residents of other U.S. states may have rights under their applicable privacy laws, including the right to opt out of the processing of Personal Data for purposes of targeted advertising or the sale of Personal Data. Vibranium Labs will honor verifiable requests to access, correct, delete, or opt-out of certain processing where required by law. You may exercise opt-out rights through the mechanisms described in the California section above.
